Contract Terms and Gym Rules

  1. Membership is always personal. The customer must prove their identity when making the agreement. For those under 18, the agreement is approved by a guardian, who is responsible for the minor's training, payments, and ensuring that the minor behaves properly in the gym's premises, also adhering to the terms and rules of this agreement. Any changes in contact details must be immediately reported to the gym's staff by email.
  2. The customer trains and/or uses group exercise classes at their own risk. This applies to all gym facilities such as the gym, group exercise rooms, and other general areas of the gym, including changing and showering facilities.
  3. Not using the service does not entitle the customer to any compensation, nor is it considered a resignation. It is not possible to resign directly from a pause. The membership must be active before resigning, following the normal six-week notice period. Resignation or suspension of membership only takes effect after the contract terms, notice period, payments, and other relevant matters have been reviewed and approved. Typically, already paid fees, including balance top-ups, are not refunded. Any remaining balance on the customer account is usable for one year from the date of resignation, after which it expires.
  4. All resignations, suspensions, and changes to the contract/service are handled by email. Messages should be sent to the customer service address porttipuisto@ole.fit. The reply will inform the customer of the contract's end, pause, or change date. Breaks and changes must be reported at least 6 weeks in advance.
  5. Membership continues after the initial period automatically as an ongoing agreement, with a six-week notice period according to the price list at that time. If the initial period includes a promotion (i.e., the initial period is cheaper than would be according to the current price list), resignation is only possible after the initial period. Special offers for new members do not apply to returning gym customers unless specifically stated.
  6. Any price changes will be notified to members 2 months before the new price list takes effect, after which the price increase automatically applies. The gym is obligated to inform members of VAT changes or other regulatory actions affecting prices at least one month before transferring such changes to the member's payable prices.
  7. Gym members have the right to bring a friend to the gym for free with separate permission from the staff. The guest must always register with customer service. The same guest can be brought to the gym for free once. After that, the guest pays the price according to the price list for guests. The member is responsible for ensuring that their guest adheres to the center's rules. If a member brings or lets an external person into the gym without permission from customer service, a charge equal to the single visit fee multiplied by five will be levied for each such unauthorized visit.
  8. The key card is personal. It must always be brought to the gym. The member must prove their identity upon request. Replacing a lost key card costs the price according to the current price list. The loss of a key card must be immediately reported to the gym staff. If someone else uses the key card, and its loss has not been reported to the gym in writing, this will result in a written warning and a charge equal to the single visit fee multiplied by five for each such unauthorized visit. If the offense repeats despite the warning, the membership may be completely terminated. In this case, already made payments are not refunded, and the member will be charged for the remaining payments due until the end of the notice period.
  9. In case of late payments, the gym has the right to charge statutory interest and reminder fees. If the invoice has to be sent for collection, the customer pays the collection costs. If the member neglects to pay the contractual payments despite a reminder, the membership can be terminated immediately. The member will be charged for the remaining payments due until the end of the notice period in addition to the already due payments. If the customer's payment is not registered within 7 days after the due date, the access right is removed, and the key card stops working. The access right and key card functionality return when the payment is registered. Removal of access rights due to unpaid invoices does not remove the customer's obligation to pay for this period.
  10. In corporate agreements, the contracting parties are Fit Porttipuisto and the member as an individual. If the member leaves the company's service or the company stops paying its part of the agreement, the member is ultimately responsible as an individual for the payments and possible costs due to delayed payments, as mentioned in section 11.
  11. We maintain a customer register. We process personal data in accordance with the EU General Data Protection Regulation (GDPR), which is supplemented and specified by national legislation. The gym's privacy policy is published on our website and is available at the gym upon request.
     

Fit Porttipuisto's Rules

  1. The gym's rules apply to everyone using its services. Members are expected to be clean and well-mannered at the gym and its events. Disturbing other exercisers is prohibited, and others' comfort should be considered despite focusing on one's own training. Peddling various products or services in the gym is against good manners. If a member breaks these rules or behaves in a way contrary to the spirit of the gym, they will receive a written warning. If the offense repeats despite the warning, the membership may be completely terminated. In this case, already made payments are not refunded, and the member will be charged for the remaining payments due until the end of the notice period.
  2. The gym may be used as a showroom for corporate events and possibly advertising shoots, during which the gym may be temporarily closed. These and other special cases (such as renovations or seasonal cleaning) will be announced in the gym and by email well in advance. These special cases have been considered when determining prices, and thus members are not entitled to separate compensation for them.
  3. The member is responsible for ensuring that the physical activities offered by the gym are suitable for them and, if necessary, should confirm this with their doctor. The member commits to using the equipment according to its instructions and guidance.
  4. During training, the member must wear clean indoor shoes or socks suitable for training. Wearing outdoor shoes in the gym is prohibited, as is moving and training barefoot. Members are also required to use a sweat towel/clean the training station for the next user. After training, equipment must be returned to its designated place, and any messes cleaned up.
  5. The gym provides lockable storage lockers for members' small items for use during training. Valuables should not be stored in the lockers, and the gym is not responsible for the loss or damage of valuables. Leaving equipment and clothing in changing rooms or lockers overnight is not allowed.
  6. Smoking in any form is not allowed in the gym's premises. Consuming alcohol, substances, and illegal drugs according to Finnish law in the gym's area or activities is prohibited. Bringing children (under 13 years) to the gym's exercise areas is not allowed without special written permission.
  7. If there are complaints about the gym's cleanliness, service, or staff, they should be reported immediately to the gym's customer service, or by email to porttipuisto@ole.fit when it is closed.
  8. The gym has an entrepreneur's liability insurance. The gym's insurance does not cover events conducted outside the gym.
  9. Intentional damage to the gym's property is prohibited. In addition to the damage compensation, the membership may be completely terminated. In this case, already made payments are not refunded, and the member will be charged for the remaining payments due until the end of the notice period. All thefts are immediately reported to the police. The gym has continuous recording camera surveillance.
  10. The member commits to scanning their key card at the reception card reader every time they visit the gym.
  11. The gym reserves the right to change the benefits, terms, and rules of the agreement. Changes to the terms will be notified to the members 2 months before the change. If it is deemed that the member's benefits have significantly deteriorated, the member may terminate the agreement immediately within 1 month of being notified of the changes. If the member has not terminated the agreement within a month of being properly notified, it is considered that the customer has accepted the changes.
